  • fingerprint notice delivered late by usps

    I just received my fingerprint notice in the mail, three days after my scheduled appointment. it's clearly usps' fault for delivering late but how can I prove it?

    the I-797C Notice of Action says "If you fail to appear as scheduled below or fail to request rescheduling, your application will be considered abandoned."

    - will that mean I just lost my $400 application fee or will they let me reschedule? did anyone experience something similar? sorry it's Thursday night, offices are closed and I'm a little upset and anxious to get this taken care of.

    any advice is appreciated.

    Why do you assume its USPS fault and not USCIS? Look at the envelope and see what date it was mailed...........then write a letter requesting a rescheduling based on the fact that you received the notice after the scheduled date....................if the request is not granted, then yes you would lose the $4000 and would ahve to start the process all over again.......

      uscis did send the notice on time according to the dated stamp on the envelope. I called and explained and was told it's not a big deal, just return the letter to the local office and request a new appointment.

        So what happened....?

        Hi Donelly, I just had exactly the same thing. USPS delivered the ASC Fingerprint appointment letter on March 20th for an appointment on March 17th!

        I will be sending the ASC I-797C letter back together with the box checked for a revised interview and keeping my fingers crossed.

        Did they reschedule yours or did you have to start all over again?
