  • Elegibility question

    Hi There,

I would appreciate if someone could tell me if I am elegible for an immediate citizenship application. My situation is as following:

    - After living continuously for 5 yrs in the States, my family and I moved temporarily to the UK. During this period of time, we've been in the States twice. The first time interval away from the country was about 6 1/2 months, while the second one was about 11 1/2 months. During these two periods of time abroad we filed our taxes in the States and had all our furniture in storage. The question is:

    - Has my "continuous residence" period been broken due to the period I've been overseas even if I manage to prove I had the intention to return and left attachments to the country behind?

Thanks in advance for your help!!!

Did you have a reentry permit, particualrly for the 11.5 months you were out?
On the surface, I would say yes, your continuous residence has been broken. Paying taxes etc. are steps you took, you could argue, to safeguard your permanent resident status, that however to me, is separate and apart from your maintaining continuous residence. In other words, while you may/are still a US resident, you failed to live in the US continuously for the last 5 years, I think.
