I live in the UK. My son was born in the US and both his parents hold Indian passports. I recently applied for OCI for my son and it was rejected because both his parents hold Indian passports! I was told that at least one parent should hold a foreign passport for the child to be eligible. Next year I will become Permanent Resident and the following year, I can apply for British Citizenship. But I am proud to be Indian and will never in my dreams think of losing my Indian citizenship for anything in this world!! So, does the government actually encourage me to forego my Indian citizenship in order to make my son eligible for OCI? So, the child of Indian parents doesn't get the privilege that the child of a foreign parent (provided the parent is eligible to apply for OCI) does??? It doesn't sound right to me. I don't think there is any clause suggesting this and I feel that the officer who rejected it had misunderstood. Or if there is a clause suggesting so should be amended!! Probably in 1955, 1956, the citizenship laws (on which OCI depends) didn't consider this scenario where Indian parents could actually have a child in another country where the child can become a citizen by birth! So, it's time to amend the laws in that case!
