  • Processing time / N-400 question help please

    Hi,

If everything goes right, how long the Naturalization process will take as of today?
Another question, if my wife is an overstaying F1 Visa holder now (at the time of my application) what should enter in the N-400 field that makes reference to her immigration status now?

    Thanks

    Vincent

If I'm reading what you wrote correctly and your wife is actually out of status, then you run a very good chance of getting her deported! Think about it for a sec: she is currently in this country illegally. Applying for USC is not a trivial matter - your WHOLE life in the U.S is scrutenized from the time you set foot on U.S. soil.

Depending on your SC/DO, the N-400 process typically takes 5-10 months.

      Deported??

      Thanks for your answer.

When you say chances to be deported ... Please did you see happen before? On the naturalization N-400 document I will tell the true: my wife immigration status is non-resident, but she has a valid social security and alien#. Do you think that via that information she can get caught?
      Please help us here.
Do you think is better for her to leave the country legally and I could apply via consular process after I got my citizenship?

      Thanks

        Thanks for the answer again.

Two scenarios. If my wife overstay her F1/OPT (she still legal now but she will be out of status at the time of my application) what should enter as her immigration status the N-400. She has been always legal here but I understand she will be no longer a non-immigrant visa F1 visa holder. She has a A#.
        - Should I enter her A# and put non-immigrant status on the field that refers to her status? Or what should I put?
        - If we decide to my wife to leave the country legally (she can do that up to two months after I filed my N-400 application but the her F1 expires a few days before. She has 2 months to leave legally the country):
        - Should I enter her A# and put non-immigrant status on the field that refers to her status? Or what should I put?

In both cases I do not think I should enter F1 as an immigration status. That will be no the case. If she does leave the country I could apply for her Green Card via consular process, what is actually faster.

Thank you so much for the input. I would appreciate a response.
        Vincent

Your wife in F1 (non resident), how can she get A#?

Your wife in F1 (non resident), how can she get A#? A# is for the green card.

            A#

I understan A# is not pnly for Green Card holders. On her working OPT authorization there's an A#.

Do you have anything on my original question?

            Thanks for aswering.

              Hi Vincent,

On N-400, the A# number you put in for your spouse is the A# from the Green Card.

When your wife's F1 will be expired, she is better to leave the country to avoid staying illegal. If she has change her status to what ever Visa which she can stay legally here (extend F1, H1B ... or 485 spending ...) waiting until you will become a US citizen then you can sponsor her then she can adjust her status here.

              Good luck
