  • Please advise, stayed out of US for 11months

    [B[/B] Hi everyone ,
i have a question regarding my citizenship eligibility.
I came to US in may 2004 as a permanent resident so this may my 3 years are completed as i came on spouse visa .. but after coming in may 2004 , i went back to india in july 2004 till may 2005 for completion of my internship[ M.D Physician] .. and after that i stayed in USA except for 28 days trip to india one again ... so i do qualify for half period stay in USA that is 18 months... but my continous residence is broken. Please advise should i apply for citizenship now ,, will i get denial?
in N400 if you stayed more than 6 months and less than 1 year , one can apply if proven otherwise.. Please advise if i can prove i was there for academic requirements will it be fine? any advices will be highly appreciated Thanks

You maybe able to apply if you can prove to the USCIS that you did not abandon your residence. It doesnt mention anywhere what one needs to prove.
The best thing for you would be if you live close to a local immigration office is to take an infopass and tell them your situation. They will give you the best advise. Good luck!!
