Indian Couple; American-Born Child: Questions????

Hello,
I am my wife are Indian citizens and are in USA for 2 years on J1 visa.

We had our first child born in USA. Now we are returning to India and plans to stay for mostly in India. I want to know how do I take my child to India along with me? The authorities in US says that I have to procure the American passport for my child and get the India Visa on it then only my child can legally enter India or leave USA.

The Indian govt. provides OCI though its not applicable for my child according to the conditions required to be eligible to be an OCI. Does anyone knows about, what visa I can take for my child so that I dont have to renew it often and it allows my child the time enough to stay with us until grown-up.

Also, can we get any advantage in applying for immigration to US based on the fact that our new-born is US-citizen.

Your valuable advice would be of immense help.

Simply put,

You have two options:

a) Get US passport and PIO card (valid for 15 years) and go to India.
b) Get Indian passport from nearest Indian consulate and go to India.

You can see the Indian consulate website and even immihelp for information on PIO card.

PIO best option

I agree. Get the US passport and get the PIO card from Indian consulate/embassy. Back in India you will need to register your child's name with local police commissioner's office.

registration not required for minors until age 15. And PIO card is renewable from India itself.
