I need your expertise advise.
On May 2001, I applied for PR (thru' married to a US Citizen- PR-US marriage base). Usually it takes within 1 year to get the Green Card or PR status, however, my case was delayed due to the 9/11 incident. I finally get my Green card in 7/8/2003 with unconditional status. The date state on the Green Card as resident since 7/8/2003.
Unfortunately I was divorced in 8/2004, so instead of qualify for Naturalisation (apply to become US citizenship) has then changed from 3 years to 5 years.
The INS officers confused me for my unconditional and conditional status, and told me I can apply US naturalization. So I did and my application was returned. Told me that I can only apply 4 years and 9 months from my PR date 7/8/2003 - meaning I can apply only in 7/8/2008.
I felt so angry as my wait is 7 years not 5 years then? I think INS should state my Green card as resident since 7/8/2001 instead of 7/8/2003. I didn't question the INS officer when he interviewed me back in 2003 as I do not know much about Greencard then.
Please tell me, when can I apply for the US citizenship? 2008 or now I am qualify? How can I let INS know that that is they delay due to 9/11 case and they should not delay my application for US citizenship? Please advise me.
