  • Marriage of Permanent Resident to F1 Student

    My partner and I moved to the US 2 years ago. I am a permanent resident and he is a student on an F1 visa and will be for the next 3 years. We would like to get married, but I am concerned this will affect my application for citizenship. Also once we get married can he apply for a greencard (but I believe it will take 5 years to get one). Once I become a citizen can this be upgraded? Or should we just wait till I get citizenship?

    Any advice would be useful. Thanks!

    You could get married (it should not affect your citizenship interview) and apply for him with I-130 (that way saving money on future fee increases) and once you become a citizen you can upgrade the petition (with a petition to the appropiate service center and a copy of your naturalization certificate) and he will be able to apply for adjustment of status.

    how far are you from becoming a citizen?

      Resided in the US for 2 Years

      I have resided in the US for 2 years, so I believe that means I have another 3 years before I can become a citizen. I would like to get married in about a year. Thanks for your advice
