  • Continuos Residence Question

    Hi,
    I have completed my 5 years of continuos residence but have not yet put in my N-400 application. If I have to travel outside for a year now with re-entry permit will I still be eligible to put in my N-400 application when I return? My question is whether the 1 year absence after completing the 5 year requirement will have an effect on my eligibility to put in my N-400 application at a later date.

    For the N-400, you must have spent the past 5 years in the USA, to have that continuous residency requirement.

    If you leave for 1 year, even with a re-entry permit, you are breaking your continuous residency.

      yes it will break you continous residence

      you may apply 4 years and 1 day after you returned to us.

        Get your USC now

        Unless it's an emergency or something big like losing your job, get your USC now and then you are free to travel for as much time as you want.

        As our senior friends have said, if you leave the country for more than six months, your counter starts from zero again.

        Not a good idea.
