I will be eligible to apply for citizenship in january ending 2009 (residence since april 2004). I am physically present in US for more than 30 months and also living in the same state since 5 years. I am planning to go to India in july 2008. Can I apply for citizenship as soon as I come back from India in mid january 2009 or do I have to wait for 3 months before applying (according to the clause: time in district/state for 3 months) ?

time in state for 3 months clarification
Does the clause : time in district/state for 3 months mean that I should reside in the state 3 months just before applying for citizenship?
So the question is: I will be in India for 6 months, can I apply as soon as I come back or should I wait for 3 months before applying?

You are continuous resident in that district/ state, if you are coming back to same address, means district/ state. Therefore, you can apply N-400 as soon as you come back.
