    Hi,

    I am a self-employed software consultant (having my own S-corporation)...In the last 3 years, I was late in filing the corporation tax returns (for State, CA and NJ) a couple of times...I did file the returns later and paid the fine that they requested for....Kindly note that these tax returns were not for personal /self but for the corporation that I own ...Again, I had a CPA to do my corporation tax returns and she screwed up....

    Now when I file my N-400, do I need to check the option "Have you ever failed to file a Tax return"....does it include the corporation tax returns since I am the owner / president of the same....

    If yes, how do I proceed with this....

    Yes and no

    Yes, you own the corporation, so you're responsible for the filing of your tax returns.

    Now the question is bit tricky for you as you have actually filed the tax returns, although late.

    Mark NO to the question and then add a letter explaining the delay in filing of your taxes and documented proof showing that these have been filed eventually with appropriate fines.

    If you send all the information now, it will save them and you a lot of time in future.
