  • Got married after citizenship interview and before ceremony date

I had my citizenship interview, few weeks later I went back home and I got married. Then few months later I have done my ceremony.
Here is how we get married back home: it is 2 steps:
    • The first one you need to appear with your fiancé in front of a religious person and then that person registers the marriage on a piece of paper.
    • The second step is to take that paper written by the religious person to the government agent that makes the marriage official and the you get your marriage certification.
I have done the first step and then I came to the states to do my ceremony.
When you go to the ceremony there is a document with 5 questions you need to answer. One question says if you get married or not, I have answered NO, because my marriage was not official yet at that time, at that time I have not that official marriage certification.
Now I’m a us citizen. My fiancé followed up and has completed the second step and now I have the official marriage certificate that has marriage date which is before my ceremony date.
    My questions are:
Now I’m planning to file for I-130 to get my wife here, will this scenario has any effect on my I-130 application? Will I have any problem?
The last question is: let’s say immigration agent says based on the above scenario you were married before you ceremony date, is that better for me? Or is it bad for me? If it was good how can I get the benefits and get my wife quicker here.
    Thanks a lot.

Double check with a lawyer, but I would submit the I-130 as is and attach a Letter explaining the situation.

      Dear Tafi,
I do not know your country of origin but in India under Hindu Marriage Act and/ or Special Marriage Act, 1954 even if you are married in front of priest consider as a marriage. Registration of marriage is just an official formality required by law to prove your relationship as husband and wife.
Check with the experienced immigration attorney as you answered incorrectly your naturalization ceremony question (date on your marriage certificate shows you were married before you acquired US citizenship). It may affect your I-130 petition. Good Luck.

I did submit my I-130 few days and hoping for the best now.
I have done that mistake without knowing and hope they won't make it big deal. I have not known that when you just stand in front of your religious person that means you are married.
I was thinking that when your get your official marriage certificate is where you become married.

Any one thinks that might lead to deny my I-130 application?
        Thanks.
