  • I urgently need help with form N-400

    Please, help me out!
    My husband is a permanent resident and now it is time to apply for citizeship. The form N-400 is pretty simple except for this one question... I came to USA on student visa that now is expired. In the form N-400 there is a question regarding the legal status of the spouse. The choise that fits our situation is "other__________________". Do anyone have any suggestions how it would be more appropriate and also correct to explain it? Will it effect the whole process and it's outcome?

    Are you still studying and have maintained status? then put "F1 Student".

    Are you out of status, stopped studying, been notified by USCIS of being out of status? then put "out of status".

    Just because your visa stamp on the passport has expired, it does not mean that your "status" in the USA has expired. The I-94 that they give you has "D/S" written on it, which means that for as long as you maintain your F1 student status (even after the visa stamp has expired) you are legally present in the USA.
