Current Situation
1. About to go to Japan and wants to work there for 3-4 years. But I have to think about my green card and prepare so that I doesn’t have any problems with it when come back from 3-4 years from Japan.
2. I obtained residency in the year 07/2002 and left to study for Japan from 10/2005 to 09/2006 without a travel document, so this breaks continuos residence. But since unknowingly I left and came back through Mexico, I had no problems getting back into the U.S. through the Mexican U.S. border.
3. If U.S. immigration has no way of finding out I left for Japan from 2005 to 2006 through Mexico City Airpot, I have the possibility of becoming a Citizenship right now. But I will get my results from Japan Work soon and won’t have much time to do the application for the U.S. citizenship until I comes back from Japan.
Vision of what I want
1. I want to work in Japan from 3-4 without Jeopardizing my green card status.
2. If possible would like to also maintain continuous resident status so that after come back from Japan I immediately apply for U.S. citizenship (If they don't find out i left).
3. If even MORE possible, I would like to have U.S. citizenship before leaving so I wouldn’t have to worry about all this other stuff.
Known Constraints
1.If I leave the U.S. for more than 6 months I need a travel document or i risk loosing green card.
2.Can only leave for 2 years with travel document (planning on staying 3-4 years)
3.If I apply for travel document, I need to wait 3 weeks so I can have my fingerprints taken and have it sent to me. (This is no problem)
4.When coming back from Japan and enter the U.S. I need the travel document or I have the possibility of having my Green Card taken away, if i do this through Tijuana Border, I wouldn't need a travel document.
5.U.S. citizenship takes from 4 months to 1 year to process so if I get the job, I cannot apply for this right away.
6.Since I already left for 1 year to Japan without a travel document, MIGHT not be eligible for Citizenship until 3-4 years later, unless they don’t find out.
7.Are Mexico/USA immigration/airports machines linked together? Therefore when applying for citizenship can they find out about me leaving the country?
---------------------------
Objectives in order of importance
1. Work overseas 3-4 years/ protect green card.
2. Maintain Continuous residence.
3. Obtain U.S. citizenship before/after going to Japan.
Plans of Action:
1. Work overseas 3-4 years. Obtain travel document 2 times and loose Cont. Resid. Risk denial of Travel Document on 2nd time.
2. Leave through Mexico Airport,Work overseas 2 years. After that get 1 travel document and work another 1-2 years. Come back loose Cont. Resid.
wait 5 years for Citizenship.
3. Obtain travel document 2 years. After 2 years, leave for another 2 years through Mexico without travel document. Come back and wait 3 years for Citizenship application.
4. Go to Japan through Mexico City for the 1-4 years of stay. Come back to the U.S. through Tijuana Border and apply for U.S. Citizenship after X period of time.
---("This is the one i'm currently looking at but it's a bit risky - i've done it before but it was 1 year only. The going back into the U.S. is not the problem, how this would affect me later when i apply for citizenship is my biggest worry. If i just need to wait about 5 years again, and nothing else happens then i would be okay i guess. But if they find out about my past and say "you left for more than 6 months" while inside the U.S. when i apply for citizenship, do they kick me out or leave me off with a warning and just make me wait the 5 years again?)
-----------------------
Questions
1. If i'm working in Japan, how can they find out about this?
2. How would they find out I studied in Japan for 1 year before, if i never left through the U.S. and paid taxes and such in the U.S. during that year?
3. If they do find out I left for Japan after applying for my U.S. Citizenship, would they take my green card away or just deny my citizenship? Would this affect me later if i tried to apply for citizenship again???
ANY advice or comments, or what you would do in my case would be greatly appreciated. Even farfetched comments or alternatives are highly appreciated.
