  • Married a US citizen, now what?

    In Feb. of 07, I came to the US (from Canada) to spend two weeks with my boyfriend. I went back and we missed each other so much that I decided to leave my job and come back to the US for a couple of moths.

    Six months after this, we decided to get married. I am now living with him, in the US (but not working since I do not have a green card). I am wondering if the fact that I came here, without filing for citizenship first, could get me in trouble.

    On one hand I was told that, since we are married, I am able to stay as long as I want here (until we get enough money to file for my citizenship). And on the other hand, I was also told that once we file, there was no way I could get denied.

    While I wish it was this simple, this seems a bit too easy. Can anyone give me some information on this please?

    P.S. Do they take money problems into account? I had some... let say bills that haven't been paid off yet. Could they deny me because of that?

    He should file an I-130 petition for you
    along with an I-485 , form for adjustment of status that will get you a green card (not citizenship, as you mistakenly said).

    You must show evidence of inspected entry to US ( stamp on passport)
    and your husband will need to show enough income/assets to file an affidavit of support for you (I-864). If he does not have the income , he can get a co-sponsor.You will also need to pass a medical exam and a background check.

      I see.

      I was told by a USCIS that I had to file for citizenship, since we are married.

      As for proof of entry, I don't have any. I did not have a passport and only had to show two pieces of ID. (this was back when US did not require Canadian citizen to show passport)

      As for the background check, I don't have any criminal record, just some unpaid bills.

      All in all, all I'm really scared about is that I will be told I have to leave.
