  • After how many years of marriage can one apply for citizenship

I was wondering if anybody can help me with some advice. I have been married with an American citizen for 3 years and 7 months (my paperwork got lost and I was asked for an interview a month before our 2 year anniversary).
I’ve got my conditioned green card on October of 2006 and I was planning in applying for removal of condition in August of this year. I just read an article in a newspaper saying that one can be eligible to apply for citizenship after 3 years of marriage with an American citizen, without applying for removal of condition.
Is this true, and if so how can I find out what is the procedure?
I would appreciate any kind of suggestions and advice.

    Thank you.

    it is not true.

you MUST apply for removal of conditions I-751, 90 days before your 2 year conditional GC expires.

You CAN apply for citizenship after 3 years of citizenship if you are still married to the same US citizen through whom you obtained residency.

if you have been a resident for 3 years, then you can apply, not only if you have been married 3 years. I see where you got confused. But believe me, you need to remove conditions and then apply for citizenship.

First you need to get a green card. As it has been 2 + years, you will get a GC with no conditions on it. Then comes citizenship after having the GC for 3 years.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

        Thank you,

I went back and read the article again and it seems that I misunderstood.
