Please allow me to present my case: married to US citizen since 97, became resident in 01, applied for citizenship in 04, approved in 05 pending FBI clearance. Divorced in 06 and finally in 08 got my invite to the Oath Ceremony.
Well, I shave and try to look good and with my Green Card and copy of divorce decree, I attend the ceremony... Apparently, I fell out of status (???) and they told me I am not eligible anymore since I am not married at the time of the oath ceremony (requirement was to be married to a US citizen for at least three years when applying). That was a shocker as the Immigration Officer was trying to explain to me something he couldn't understand either, however it seems to happen in one out of one thousand cases.
The good news is that I am still eligible since I've been a resident for at least five years, but I will have to start the process all over again.
Needless to say, I would gladly go through the new path, but I do hope it can be a way to inquire and eventually get someone to review this decision.
Can anyone any insight?
