N-400

Guys, Need help regarding my N-400. I just received mail from USIC asking me to keep ready all the info about the speeding citation I had listed on my N-400 form when I go for the interview.

I don't have any of the citation since it was almost 2 yrs back. Any ideas.

Get driving record from MVC and/or municipality court where you paid your speeding ticket.
Seriously, you will need it at the time of interview, even if it minor speeding or traffic violence.

Minor traffic infractions are not to be reported on the N-400. That is not what they are asking for. Did you read the N-400 instructions and the Guide to Naturalization prior to filling this form? If you had, you would have noticed that traffic violations such as speeding, running a red light are not to be mentioned at all. What they are wanting to know is if you were involved in a crime such as a serious accident and you fled from the scene of the incident.

Now that you have made an error, you may have to go to your courthouse where you paid your fine for the citation and ask them for a copy of the paid receipt.

Hi ASM,

I just read once again the N-400 instructions /show-form/n-400 and I dont find anywhere it says specifically not to mention about the speeding, etc. Could you please let clarify about this?

Citation

I went to interview on 9th & took my oath on 15th.
I had forgotten to mention my speeding ticket in 2000 on N-400.

When went to interview. Before she starts asking I took the copy of citation & told her that I have forgot to mention same in N-400. She just kept the copy aside & started normal interview.

They are looking for DUI or criminal offenses. But be honest from your side. You dont want to screw your 8-10 years of wait just for one ticket,

Dear members,
They do look your driving records. If you forget to mention on N-400 then let them know at the time of interview but if, you forget to mention on N-400, do not tell them at the time of interview, and if they find any offence on your record, will have negative impact on your case, off-course, everything depends on who is taking your citizenship interview? They are just looking your moral values other than DUI or serious crime (which cannot be revealing by ticket#). Then why, you want to take chance?
Rest is just depends on you individuals.

Driving Citation

Here is an excerpt from M-476 on pg 25....

If you have been arrested or convicted of a
crime, you must send a certified copy of the
arrest report, court disposition, sentencing,
and any other relevant documents, including
any countervailing evidence concerning
the circumstances of your arrest and/or
conviction that you would like USCIS to
consider. Note that unless a traffic incident
was alcohol or drug related, you do not need
to submit documentation for traffic fines and
incidents that did not involve an actual arrest
if the only penalty was a fine of less than
$500 and/or points on your driver’s license.

I think, you miss answer of question # 7 (first line of last paragraph) on the page # 8 (not page #25) of N-476, A guide to naturalization. It state that “Even if you have committed a minor crime, USCIS may deny your application if you do not tell the USCIS officer about the incident (They did mentioned about traffic incidence).

On page # 25, they mentioned in one line about “Lying to gain immigration benefits”. Now, please read my previous posting.

traffic fines of speed of speeding, red light,etc are not considered as a crime for citizenship purposes, unless that traffic incident was involved with your arrest. it could be due to drunk driving, drugs, or a major accident that kiled someone, etc.

and it's true, for citizenship purposes you don't need to report any trafic violation of regular basic tickets like spedding, jumping red light, etc. unless that incident turned into the things I mentioned above. like any arrest.

but it's great idea to carry the paid proof those receipt of that kind of traffic violation, an officer may ask for that. If you don't have it, then it's upto the officer whether he or she believe on your story.

It is best to mention about all types of traffic tickets. Jumping red light, regular speeding don't really matter for getting citizenship, but still mention them.
