  • N 400 application

I am in the process of gathering the appropiate documents for my n400 . I am applying of the basis of 5 yrs permanet residents, it is very unclear to me. do I need to send my income tax returns ? or is this only applicable if you you apply on the basis of marriage.
    Thank You

You must send last 5-years tax transcript from IRS.

No you need to send Tax Transcripts

As per M-476 pg # 48 - Document Checklist there is no need to send Tax documents except if you are applying for naturalization on the basis of marriage to a U.S. citizen....

Word of suggestion to contributors....Please do not provide your opinion unless you have material facts to support it. You are misleading and hurting the requester with incorrect information.

Advice asked for and provided ...

... you take it or leave it, do not criticise.

You need to do your own research and gather information from all possible sources.

You may be correct in this particular respect, still you need to be polite and indicate your contradiction professionally without criticising.

By the way, sending the info will help and not hurt the case.

        Good luck & best regards.

          Dear kshahusa,
I think you miss whole concept of naturalization, on page# 48 of N-476, A guide to naturalization, they mentioned document check list on the basis of marriage to a U.S. citizen not applying US citizenship on the basis of 5 yrs permanent residents (Also, I think you miss the page #49)..

If based on marrying to US citizen, they are asking an IRS tax return transcript for the last three years, then based on 5 yrs permanent residents submit last 5 yrs tax transcript from IRS.

Knowledgeable (Senior Member) is right. Take it or leave it but do not criticize

          Thanks.

Tax returns only if you stay out of US more than 6 months

            Dear Members,

If you read the page 49, it says that if you stay outside US for more than 6 months then only they are asking for the 5 years tax returns
If you have taken any trip outside the United States that lasted six months or more since becoming a Permanent Resident, send
evidence that you (and your family) continued to live, work and/or keep ties to the United States, such as:
An IRS tax return “transcript” or an IRS-certified tax return listing tax information for the last five years (or for the last three years
if you are applying on the basis of marriage to a U.S. citizen).
Rent or mortgage payments and pay stubs.

            Hope this helps.

            Thanks

I apologize if I've touched your sentiments with my commentary...I strongly feel that this forum is more then sharing opinions and thoughts.....

Nothing personal...value of this information lies in the eyes of the beholder...we can truly discipline ourselves by citing clear references or make it as clear as mud...

                Uscis ...

... obtains all your tax returns that you file with IRS, so technically they already have all the data with them.

Now, irrespective of the form, if you do submit the same to them while filing, it will help clear a lot of things for you and make your path very clean and smooth.

All those who've submitted have informed me that they never had any problems, but actually had easier transactions.

Take care and good luck to all.

guys...... I think "kshahusu" perfectly said it right and politely by mentioning the words: "word of suggestion to contributors"

I agree with "kshahusu" and "bg3" that you do not need tax returns or transcripts unless you have taken any trip outside the US for more than 6 months. they are not looking for how much you are making. they are just asking for your ties to the country when you do spend more than 6 months outside the country.

Never provide more information than you are asked for. for example if they are not asking for tax return, don't send them.
