  • Questions about Eligibilty for Citizenship

My wife and I got our green cards in Aug 2004, which means I can apply
for my citizenship Aug 2009, say. Here is the situation though.

    - My wife was out of the country for 5 and a half months (definitely less
than 180 days) in India (28 Oct 2005 to 10 Apr 2006) and she came back with a reentry permit. Will this be any problem when we apply for her citizenship. Will she be eligible to even apply ?
    - My daughter was born in India in Feb 2006 and she came to US as a green card holder in Apr 2006. Can I apply for her citizenship also in 2009 (she would not have completed 5 years as a green card holder). Will she be treated as a dependent of mine and given citizenship ?

    Thanks in advance.

Re-entry permit is not a problem because she didn't use it as she came back before six months. just be ready to provide the proof when an officer ask you the reason for your re-entry permit. please show your arrival and departure stamps as proof of your less than six months visit.

Do NOT apply any application yet for your daughter because she will automatically be citizen when either of you become citizen. she doesn't have to wait for 5 years. she is citizen when either of the parent is citizen.
This rule applies as long as she is under 18.

After either of you become citizen, you have two options for your daughter:

      1. apply for her US papport directly.

      2. File N-600 for an extra proof of your daughter's US citizenship.
