    Hi Everyone.

    I have few questions for my eligibility of Citizenship. Below is my profile background and questions.

    Background:

    - My wife became US Citizen in 2003 and we got married in India in Apr 2004 (marriage registered in India, not registered in US)
    - We lived in india for 6 months and filed for my immigration from India. We both landed together in US in Oct 2004 (within 6 months)
    - I got my permanent GC in Apr 2007 (removed the conditions from my GC)
    - We dont have any kids as of yet and are not planning to have any due to our bad married relationship
    - Our marriage was purely on Good Faith and I did not intend to get GC thru marriage, but now I intend to get citizenship w/o any problems (either before divorce or after).

    Questions:

    1- Can I apply for US Citizenship now (as of Oct 06, 2008)..?
    2- If YES, Do I need my wife's consent or signature in my citizenship application, since our married relationship is not going smoothly..??
    3- Do we need to get divorced in US or India, since our marriage is not registered in US..??
    4- If we DO get divorced before I become citizen, would I face any difficulty in getting US citizenship (its already been 3 years that we landed in US and WE HAVE LIVED TOGETHER ALL THESE YEARS)..?
    5- Future consequences: After divorce if I get re-married, would I face any difficutly in bringing my wife in US..??

    WOW.... dont even think about filing and then divorcing... they are now monitoring these marriage cases.

    I personally will wait until 5 years, but i dont know your plans...so i will say

    work things out with your wife and do your calculations regading years and continous residency and so on.

    It is important you dont make USCIS think the marriage was for immigration purpose.


    Questions:

    you can apply if you got your Condition card in 2005

    2- If YES, Do I need my wife's consent or signature in my citizenship application, since our married relationship is not going smoothly..??
    You dont need her signature, but you will need to submit joint taxes, marriage cartificate (foriegn or US) etc

    3- Do we need to get divorced in US or India, since our marriage is not registered in US..??
    I am against Divorce. You can marry in Mars and divorce in US... (family court)

    4- If we DO get divorced before I become citizen, would I face any difficulty in getting US citizenship (its already been 3 years that we landed in US and WE HAVE LIVED TOGETHER ALL THESE YEARS)..?
    You may (RISKY move)

    It seems you have already have an intent. Well you may have to wait a couple of years before re-marrying. INS takes not of dates.


    Like i said my best advice is to Calcualte the day you got your Condition Residency (first date) you count from then to this OCT 08
    If you dont feel comfortable wait til 5 years and apply

        Check your resident start date on your Green Card. Complete full 5 years
        then apply for your citizenship. You will NOT have any problems.

        after 5years of resident start date, citizenship has nothing to do with the marriage. but remember you must complete 5years.
