    Can somebody please advise me??
Mywife and me applied for citizenship (after 5yrs of GC). We did not get any FP letter yet. Our marriage is not working verywell. So we are seriousely thinking whether to take divorce or not. I do not know any impact on our application if we take divorce. Please help me suggesting with any better approach. Does any one has any experience in these lines. Should INS consider the divorce as negetive on us??

    Thanks,
    Ven

    Absolutely ...

...any separation or divorce will create hurdles in your United States citizenship application.

    Best options:

    1. Try to reconcile.

    2. Consider separation AFTER the USC is granted.

    3. Just do not divorce now.

    Good luck.

Why? If the GC was not due to marriage based petition, what is the issue?

      OP,

Was your GC employment based or family based?

          Oh...ok!

I was wondering what the problem could be from the legal side.

My Green Card is Employment Based GC. After we got married, she came on H-4 (dependent Visa) and then we applied for I-485, got the GC in oct, 2002. I also changed the Employer after getting the GC.

            Thanks,
            Ven

                Knowledgeable,
Thanks for your concern. But we both are not really happy with our marriage. We both are working, financially independent. Why to live unhappily our entire life? We are getting seperated with no quarrels to go for betterment. If we did something wrong now and If we really want each other, we can always re-unite. We do't want to live with unhappiness, we tried for long time. Anyway, I appriciate your thinking.
May be I need to see the Immigration lawyer on this to clarify more of the divorce impacts. I just want to know fro all of you guys also. I know, people like you me or better and honnest than lawyers. But we have limited knowledge on the topic. Please let me know as much as you know, that will help me decide. If we have to postphone, we will consider that. But if divorce does not impact much, we will re-start our life as soon as possible.

                Thanks for your info/suggestion,
                Ven

                  From whatever ...

... knowledge I have gathered, if both of you are permanent residents and at least one of you have got your GC through employment, then you're good.

You can file for separation or a divorce and continue with your citizenship processing.

You may need to file an addendum in your citizenship application stating the current fact.

Yes, I personally do not like divorce unless its the very last option that you have. You're both educated and knowledgeable, you know what's best for you.

                  Good luck.
