I got married to a US citizen in October 2004. Unfortunately, I was divorced. I filed application based on VAWA (Violence against women act) for I-485 / green card.
During that time I was on temporary green card and unfortunately,I was trapped at one of the store in NY for shop lifting. I was innocent and I didn't want to accept, but the government attorney told me it would come as if it was violation ( I was in custody around 24 hours). I didn't accept it during the first trial and in the second trial the attorney forced me to accept it. The judge issued me 6 days of community service. I performed it. The actual charges I was convicted of were for disorderly conduct.
In august 2007 I received my green card in NY. Then in June 2008 I visited my family in India for a month. When I arrived at D.C airport the custom and border control police stopped be based on my previous conviction which was already expunged.
I was put under deferred inspection. I went for that deferred inspection with attorney, but border control police didn't listen to him either and detained me.
Finally, my lawyer convinced the DRO head about the charges that those were disorderly conduct not anything else. I was released after spending a day in the DRO place.Finally, I got my lawful admission done ( My passport got stamped ) D.C airport.
I spoke to DRO head and one more officer and they said sorry. They said it was a mistake by Custom and border control police.
Now I am afraid of traveling to India and applying for citizenship which is due next year.
Could you please advice best of your knowledge what can happen if I apply for citizenship?
If some emergency situation arises can I visit my family in India and re-enter to the US without issues?
Is there something that I can do from my end?
My attorney suggested me to register a complaint against Customs and border control police. I am afraid of it.
