    Hi

    My Husband was filed N400 application for naturalization on basis of marriage to a US citizen/ with me, The INS office sent letter to bring an original IRS tax information for past three years or copies income tax forms, problem is we didnt file tax together, any body same problem please please somebody exp to give us advice, should we have to cancel interview or application N400

    Please advice us

    What the USCIS is trying to figure out or prove is that you have been married for three years, living with your Husband together all three years and more and you are a citizen for three years. With you not filling taxes together should not freak you out. You Just need a good answer as to why you didn't file together. ( Maybe you thought that helped with taxes while filled separately). Be ready with a Good answer.

    Now without Taxes filled together, He will need more documents to prove he has been married and living together for all the three years. Look for documents like Car registration with both of your names, Utility bills with both names, Insurance documents, kids birth certificate if you have any kids, Credit cards statements with both names, Lease with both of your names, and the list goes on. Anything basically with both of your names on it for the past three years.

    Should we have to cancel interview or application N400.. I would say No. He should go for the interview and explain to the Officer why he does have the taxes filled together, and carry the other evidence.If he cancels, he looses the filling fee anyways! Why not just give it a shot.

    If he don't have any of the above documents, most likely it will be a hard sell to the officer that you have been living together. Worse case scenario, He can apply after 4 yrs 9 months of being a permanent resident and he will not have to provide all that three yrs tax scripts and other evidence.

    Thats my take!
