I got my greencard based on marriage in 2004. We seperated in 2005. I filed my application in 2007 not based on marriage even though we were still seperated. INS returned my documents since I didn't qualify at that time based on the fact that I only had my greencard for 3 years. This year I filed again because I was now eligible to file on my own.
The officer brought the 2007 application to my attention stating that I filed while we were seperated. I told her I didn't qualify then and the paperwork was sent back to me. She asked if I was divorced and told her I was. She then went and consulted with someone else - returned to me and mentioned that she wasn't sure if she will need my divorce certificate but if she does, I will receive something in the mail.
She conducted the entire interview, passed the English test and the history. On my way out she gave me a document where she checked a decision was not reached.
Any advice would really be helpful.
