    Hi GUys! Im a Greencard Holder and petitioned my wife who's in the Philippines . As I understand my children are derivative beneficiary under the said petition so I only filed one petition w/c is for my wife. Somebody told me that once I got my Citizenship I can upgrade the petition for my wife thus will expedite the process of her getting to U.S.. but the bad news is, my kids (minor age) is no longer a derivative beneficiary.

    What should I do?

    1. Could I file separate petition for my kids now considering the fact that I'm just a permanent resident as of this time?

    2. Will they (my kids) still be considered under my wife's petition even if I file separate petition for them?

    3. If I file separate petition for my kids right now and get my US citizenship later can I upgrade my petition for them? How long will It take for them to get here in US if I do upgrade said petition after I got US Citizenship?

    I don't think anybody knows the answer for your question in this forum. These questions can be answered only by a experienced Immigration attorney.

      Hi! As far I know if you are a LPR you can file 1 petition for your wife and children but you can also file separate petiton for your children aswell so if you naturalize you can upgrade your petition... because once you naturalize it is one petition to one benificiary, so much better to file it now separately... although another fee but more convient in the long run... once you naturalize and upgraded your petition is will only take 6-8 months for them to be here...
