  • N-400 and Physical Presence

    Hi there,

    I am greencard holder thru employment since 2001 however due to frequent international assignments could not apply for citizenship earlier. Now I am trying to fulfil my physical presence condition. In the last 4 years I again was on a foreign assignment but we used to visit USA before 6 months has lapsed. So none of our trip out of USA in the last 5 years was more than 6 months. We rented our house in USA since my assignment was long term. I kept the bank account. Filed for taxes all these years with foreign income shown. In N-400 form section where we are supposed to enter the addresses where we stayed in the last 5 years, I intend to mention my foregin address where we stayed for about 2-1/2 years. I have the same employer thru which I got the GC and these assignments were with the same employer too.

    I would want to know if this foreign address will create any further questions that we need to prepare ourselves, any supporting docs that you will suggest.

    I'll appreciate your help.

    If you have filed the taxes and stayed the majority of the year in the US, it should not cause any problems. Do mention the addresses that you have lived in the past five years correctly and as you would mention the duration of each overseas trip(which will be less than six months) you would not have any issues.
    Have all the necessary documentation ready in case RFE is sent to you

            An RFE is generated whenever USCIS believes that it requires more paperwork/evidence to move your case forward. RFE is not necessarily bad. They(USCIS) want more information..

              I'm surprised that you didn't know about it. RFEs are very common in GC process & many other Visa processing :-)

                Parents with Greencard

                Hello all,

                Can someone please comment as to what USCIS is specifcially interested and what questions they ask when they ask for tax transcipts?

                I am claiming my parents as dependent for the last few years. They received their greencards thru my sister's petition 12-13 years back.

                I wonder if claiming them as dependent can have any negative affect on my N-400 application?? Please do comment if you have any experiences. Thanks

                  In the simplest of cases, they may just want you to bring your tax forms and nothing else.
                  Or they must have noticed a discrepancy in the tax documents they received from IRS and may need a clarification. Make sure you have a reasonable explanation for any tax breaks you took and you should be ok.

                    N-400 and tax transcripts

                    Hi all,

                    I was out of country for more than 6 months in 2001 the year i received my greencard. Since then I have not been abroad for more than 6 months in any single trip. Due to shortage on physical presence I am completing my time nowadays before i can apply for N-400.

                    My question is wrt N400 document requirement page which ask applicants to send tax transcripts if any time after receiving GC applicant applicant has stayed out for more than 6 months. Common sense tells me that since that stay was almost 9 years ago i should not send any transcript with my N-400. Please advise if this approach of mine is ok.
