  • Looking for answers. Please HELP !!!

    Hello,

    I have gone through many really helpful threads here. I just have few quick questions and will really appreciate any help. Here are my dates for ref.

    Green Card issued : Dec 10, 2004

    got DUI : Aug 13, 2005 (got 6 month probation)

    My questions are

    1. Since I have DUI, can I still file I-400 myself or it's recommended that I go via an Immegration Lawyer?

    2. Do I have to wait 5 years after the DUI date to file for I-400 or I'm good to file, as I am over 4 yr 9 mo. period?

    Any answers will be highly appreciated.

    1. A lawyer is not required because you have a DUI. Provide support that you have been a good driver since your DUI incident. Do document your case clearly, if you try to hide any info and they find out, it may hurt your application.

    2. You are good to file 90 days before the 5 year expiration.

      Thank you for your reply.

      I have another quick questions if you get a chance.
      I got my and wife's green card in Dec'04 and my Son's card came 3 years later.

      I'm thinking that I will not file his I400 and check it later when\if I get our approval first.
      Does it make sense or try to file his application with us only ?

        if your son is a minor (age <18yrs( no N-400 can be filed, in fact none is needed.
        After your citizenship is approved, you apply for N-600 for him to request for a certificate, sa he becomes a citizen if either of you is naturalized. But above is true only if he is a minor still.
        If he got FB GC and an adult he is eligible after 3 years.

          I applied for a US passport for my minor child after I got my citizenship. I did not apply for the N-600 which i way more costly. Go to dept of state website and look at passport requirment to proof citizenship for minor child.
