  • Getting married to a US Citizen

    A while ago I had applied to become a Citizen based on 3 y.o marriage to a US Citizen. Before the oath I divorced- therefore I was told to apply again, based on 5 y.o eligibility period.
    After the divorce I met someone, we have a baby and we want to get married and apply for his papers as soon as I get my Citizenship.
    We've been living together since I got pregnant.
    Someone was telling us that I can't be his sponsor because I got divorce after 4 years and 9 monts instead 5 years.
    I'm pretty confused. Has someone ever been in a similar situation? That just doesn't seem right to me.
    What are his chances?
    I would truly appreciate any help!!!

    I just want to add, I got my green card through my ex-husband.

      You can to marry anytime (defending on state laws, in Texas is a month) after your final divorce was granted.

      And once you become a US citizen, then you can petition for you new Husband.

        So there is no law stating that if I got a GC through my ex-husband and I became an US Citizen basen of 5 y.o. eligibility AFTER THE DIVORCE I still had to stay in the marriage union for the full five years period to be able to petition for my new husband?

          Just read your post in the forum from 10/09, I got my permanent residence through my ex-wife, we ended up divorcing, the marriage was in good faith, did you have any problems, as to the IO getting into details about your divorce and did you have to prove that you marriage was in good faith........thanx
