  • decision cannot be made after 120 days

    Hey everyone
i passed my interview on January 3/2019
    in BALTIMORE MD
and received “decision cannot be made”
120 days passed last Sunday May 3/2019

i was trying to get an INFOPASS
and got an answer “This office is not accepting walk-in requests or scheduling InfoPass appointments.

    what are my opinions now??

when i checks uscis website after my interview
it says that the process will take until February 2019
when I called yesterday they say it can take 22 months
I am afraid that by the end of 22 months they will push their processing time , the same way they did now

    any advice???

    Send my application 1/26/2018
    biometric was 2/20/2018
    interview was 1/3/2019

Hello. Baltimore is currently taking 10.5 to 30.5 months for family based, so you are still well within current processing times for Baltimore. You can't even inquire yet, as the PD date for inquiry is currently November 15, 2016. You've got almost a year to go before you can inquire. Suggest you be patient.

Hi guys, this is odd, don't you think? the rule is that after the naturalization interview if they don't give a decision within 120 days then you have the right to go for a writ of mandamus to force the court to make a decision. In the N652 document that they give you stating decision cannot be made, you can see the 120 day limit mentioned at the bottom. Now whether you pursue a writ of mandamus or whether that is the right approach only you and a lawyer can determine. FYI, my wife and I went for citizenship interviews on April 18th. She passed and completed her oath on May 7th. I got a decision cannot be made status. I also saw in another thread here (called decision cannot be made after 120 days) that the applicant is not even able to make an infopass appointment. i am not sure whether this is normal and what timeframe most decisions are made within.anybody looked at the tracker?

        You are right
they don’t give you the option to make a infopass,
and the always extending the waiting time( it was February 2019,when February passed, they extended it to October 2019,

If you want to file a writ of mandamus, go ahead. You only lose a few dollars in attorney fees if you use an attorney.
