  • Pending Citizenship Determination meaning

Hi!! I was doing a research of documenta because I want to apply for my Derivative Citizenship since I'm now 27 and I found this on my baby mexican passport (it's a Visa) and the consular officer told my mom that he was going to approve just 3 months because I was "US citizen" and they had to do the paperwork.

The phrase in my Visa says "Pending Citizenship Determination"

Sob was wondering if anybody know what does that mean and if it could help me with my process.

I'm totally guessing here because I can't tell which country was involved with that Visa and I can't tell which Consular office you are talking about.

I think the following may be true if I read between the lines...

When you were a baby and your mother tried to get you a visa for some country (I've no idea which).... the people issuing the visa had no idea what your actual citizenship was!
Instead of rejecting the visa application and insisting on seeing your Birth Certificate... they did you a favor and gave you a 3month visa to help you to travel.
When they wrote "Pending Citizenship Determination".. this is probably just their way of saying "I can't figure out what the Nationality of this baby is!!"

I'm not sure who said the words "You are a US Citizen".... only your Birth Certificate can really answer that question.
I'm not convinced that the words on the visa can help you much.... I'm not convinced that they can hurt either. I think they were just doing your mum a favor so that she could travel with you.

Like I said...this is all totally guesswork.
Hopefully you actually KNOW what nationality you are by now... right?

You don't "apply for derivative/acquired citizenship". You either have it based on the facts, or you don't. From your description, you probably have US citizenship, but don't have the documentation to prove it yet.

It sounds like what the phrase meant was that the US visa officer was pretty sure you were a US citizen at the time, but you hadn't gotten documentation of that fact yet, so they issued you a US visa (which are not supposed to be issued to US citizens) in the meantime.

It's possible that your mom applied for a CRBA and/or US passport for you when you were little, and you just don't know it, in which case it might be easier for you to get a US passport now. Or, you would just have to find all the evidence that establishes that you acquired or derived US citizenship.

This is my personal opinion and is not to be construed as legal advice.

        Trying to get more facts:

Would it possible for you to upload an image of that passport page showing the entire visa stamp (without the red circle on it).
That would help us see which country issued the Visa.

Also, are either of your parents US citizens? One? Both? Neither? (very important).
If I asked that question one day before your 18th birthday.. what would the answer have been then?

Do you have a copy of your birth certificate? Which country issued your birth certificate and where were you born? (very important).
If you were born in the US, copies of your birth certificate can be obtained for about $20. Apply here: https://www.cdc.gov/nchs/w2w/index.htm
