    I have a Green Card and I am preparing my n-400 form to get US citizenship. I am filing according to the first option, having been in the country for at least 5 years. However, I have also been married to an american woman for more than 3 years. Short question: should I include a copy of my marriage certificate with my application?

    The motivation for my question follows.

    In the instructions for the n-400 form, on page 10 (see link here: https://www.uscis.gov/system/files_f...pdf?download=1) one can find a list of required evidence to submit with the application. Item #3 is “Photocopy of your Current Legal Marital Status Document.” So, it seems that I should include a copy of my marriage certificate with my application.

    However, if you go to the “10 Steps to Naturalization: Understanding the Process of Becoming a U.S. Citizen” USCIS page (see here: https://www.uscis.govhttps://www.imm...ly-citizenship) and then click on the document checklist (see here: https://www.uscis.gov/sites/default/...PDFs/M-477.pdf) it says that, if I am applying for naturalization on the basis of marriage to a U.S. citizen (which I am not), then I should include a copy of my marriage certificate. But such copy is not required otherwise.

    So, should I include a copy of my marriage certificate with my application? I know it does not hurt to add it, and I already have copies. But we got married abroad and so I would have to include the certificate (a fancy decorated page), its certified translation, an extract of the marriage certificate with more info on me and my wife, and its certified translation. I already have those and plan to bring them to the interview but I do not want to send them in now if not needed.

    It's never good to get conflicting instructions is it?

    If you send it and it was not required... they will ignore it.
    However, if you do not send it and they wanted it... it will delay the case if they then have to ask you via a "request for evidence"
    Notice that they only ask for a photocopy NOT the originals.... if it is simply a matter of sending (or uploading) a few scanned pages... why not send it anyway?

      Just to follow up, in case somebody reads this in the future. I just filed my application online and there I was told that I will file according to the first option on the n-400, having been in the country for at least 5 years. But, since I am married, I was asked to submit a marriage certificate anyway (and a translation too given that it was in a foreign language). If the online form is set to what Uscis by default expects (which I think is a good assumption but who knows), then those who are in my same situation and apply by mail should also submit their marriage certificate. So, the answer to my own original question ("should I include a copy of my marriage certificate with my application?") is "yes, you should include it".
