    Hi !

    If I am sponsoring my parents ( I am over 21) and a citizen, I am a bit confused on the process. My parents are currently visiting me in Cali. They are planning to back home to Germany in Oct. They booked their tickets already. Can I file for the their I-131 now or when they go back to Germany? Once it is approved, do I need to file their I-485 ?

    I don't know if you can file I-131 first. All the posts I read are from people filing everything together.

    You need to read I-131 instructions, you may not be able to file if there is no I-485 pending.

    If you file now, I don't think they will get the AP to travel abroad before October. If they need to go back, then the AOS process will be abandoned and when they get back to Germany you will need to start consular processing. Is better to start the process when they are in the USA and don't travel back in October until the AP or GC gets approved.

      I think you meant to say I130 (I131 is for Advance Parole). Yes you can file I130 now. You can choose to file I485 along with I130 or file it later. The beneficiaries need to be in the US for filing I485. Hence, it is recommended that you file I130 and I485 concurrently.
