3 years after Marriage? Or 3 years after receiving the Green Card?

  • 3 years after Marriage? Or 3 years after receiving the Green Card?

    Hi Guys
    I know we can apply for naturalization 3 months before completing 3 years. (in the case of Green Card through marriage).

    Is this 3 years counting the day I received my Green Card ? (02-feb-2019)
    Or is it the day I was married? (24-mar-2018)
    (I applied for the Green Card 3 days after my wedding, at 28-mar-2018).

    3 years after receiving the green card (if you were married to a US citizen for the entire 3 year period).
    Otherwise 5 years after receiving the green card.

    To be safe, add on an extra day or two. People have had their applications denied for applying just one day too early.
    That probably happens because of the 90 day rule being misinterpreted as a 3 month rule.

    In your case,
    You got the Green Card on 2 February 2019
    Your three year period will have been satisfied on 2 February 2022
    (To avoid applying one day too early... add a week to be safe to make this 9 February 2022)

    If you are allowed to apply 90 days before that date... that would be 4 November 2021.
    Again.. adding on a week just to be safe.... Let's say you could apply on 11 November 2021.

      I didn't know that you can apply for naturalization 3 months before completing 3 years. The information here:

      say "Have been a permanent resident (Green Card holder) for at least 3 years". I read that as "you can apply after 3 years with your GC".

      Answering your question if is from when you received your GC or when you married, it is from the date they approved the GC. I don't have a GC yet, but it looks like the card says "Resident Since', so it is 3 years from that date.

      Day 1 - Package received at the lockbox
      Day 999 - Card delivered to me - Aug 2021

        Let's say 25 March 2021 to be safe.
        So you could apply 3 months before then which would be 25 December 2020.
        Again.. adding on a few days just to be safe.... Let's say you could apply on 31st December 2020.

        Make sense?

            It's 90 days early, not 3 months. 90 days before February 2, 2022 would be November 4, 2021.
