  • Should I also send the marriage certificate ?

    Hi All,

    I'm going to fill out N-400 in a few months but trying to get myself ready .... I'm going to apply based on the 5 years residency and I was married once ... should I also attach or send my marriage certificate even if I'm not married anymore and I'm applying based on the 5 years rule and not the 3 years rule ?

    on page 10 it says

    3. Photocopy of your Current Legal Marital Status Document. Provide a photocopy of your current marriage certificate, divorce, annulment decree, or death certificate of former spouse.

    So the relevant paperwork would be your divorce or annulment decree depending on how your marriage ended.

    Single: Send nothing
    Married: Send Marriage Certificate
    Divorced: Send Divorce Decree
    Annulled: Send Annulment Decree
    Widow/Widower: Send Death Certificate

      I'm a widower so it it will be the death certificate .

        I got my green card through marriage and later divorced. I filed N-400 on 5 year rule. I was required to send a copy of my divorce decree. I did not send my marriage certificate but had it handy for interview. It was not required. Or asked for prior to the interview.

          Thanks Mike , that makes it clear that how the marriage ended is the important document

          but i think you also mean even during the interview they didn't ask for the marriage certificate , right ?

          In all cases I'll keep it handy

            Hope everyone is having a great day.I am a US Citizen and Wife has an EAD /I 766 (EB-2 India). We have recently been married. How can we apply and expedite the status adjustment from EAD to Green Card for her. I understand this is a unique situation but if anybody can shed some light on this would be highly appreciated.

              You might have better success if you start a new thread for your question. Many of us will not read your question because it's tucked away inside a different thread that has been "resolved". The only reason I saw your question is because I'm subscribed to this thread due to the fact that I participated on it. Make sense? Unfortunately I cannot answer your specific question.
