Hi All,
In 2000, after I started my OPT, I was working for two months, then
got laid off. I got several offers but continued interviewing till I
got a good offer after 1 and 1/2 months. I finally started my new job
after 2 months and 3 weeks of unemployment. I am currently on GC. If
I eventually apply for citizenship, will this affect my case? Does
the officer ask questions about status during OPT etc? If asked
generally about my background, should I mention this or will it be
considered lying under oath? Was I in legal status at that time? If
not in valid non-immigrant status, a person is supposed to apply for
Selective Service and I did not. Does this affect me? From what I
have read, there were no specific rules on OPT in 2000. In 2008, the
new rule allows 90 days of unemployment. So, I feel I am in the
clear. Appreciate if someone can confirm this. Also, USCIS says 'An F-1 student who is authorized by USCIS to engage in optional
practical training (OPT) employment is required to report any change
of name or address, or interruption of such employment to the DSO for
the duration of the optional practical training.' Was this in effect in 2000? Is it necessary to get
a letter from an attorney clarifying above points during the
interview.
Thanks!
