    Hi everyone,

    I have few questions for my mother's citizenship application. I would greatly appreciate your advise/help.

    1 - My mother will reach the eligibility of stay (90 days to 5 years of stay) by end of next year. But, there has been one time that she had to stay out of country (In India) for more than 6 months. This was due to medical reason. She had major knee replacement surgery in both legs and due to other complications, she had bone grafting surgery. She was hospitalized for a month and then she was in bed rest for about 4 months. Due to doctor's recommendation, she could not travel back within 6 months, but as soon as it was possible for her, she returned to US. We have all medical documents from the doctor in India to submit with the application. She lives with me here and has continued living with me during all 5 years. Can this situation be considered to fulfill continuous residence requirement? Do I need to get the medical papers from India validated from any doctor here? Should I also write a letter stating that I am her daughter and she lives with me?

    2 - My mother has not worked in this country and she is 65+ years. Does she still need to file any tax documents? She has no tax returns as she has no income here. Please advise what do usually people do in this case?

    I greatly appreciate any suggestion/help in this matter.

    I don't think there is a way to know for sure if they will accept that but I think there is a good chance. You will need to supply the documents and a translation of everything that is not in English.

    I guess if she is retired and not working, then instead of tax documents a letter explaining that she has no income and how is she supporting herself. The government wants to know if the person will be any burden to the economy. I think you can add a letter explaining her situation. If you have her as a dependent on your tax returns, maybe you can add them to the application.
