  • How to change green card to citizen status.

    I am become a u.s citizen in jan2020. My wife she has green card. How to switch her immigration file. Because she want to u.s citizen after 3years , not 5years. Is it possible? which form fill out?

    Did she apply already?
    She need to fill N-400, just like you and have proof of your citizenship.

      No, she did not apply n400. When she is coming in United States that time I am green card holder and now I am citizen. So no any extra form fill out, And is it she apply after 3yrs? And N400 fill out and showing my citizenship certificate so they accept?

        There is no need to "switch" anything. When she files N-400 to apply for naturalization, she will specify the basis (5-year rule, 3-year rule, etc.) she is applying under. Note that she will only qualify for naturalization under the 3-year rule if she has been a permanent resident for 3 years, she has been married to you for 3 years, AND you have been a US citizen for 3 years. So she will not qualify for naturalization under the 3-year rule until Jan 2023. If she got her green card before Apr 2018, she will qualify to apply for naturalization under the 5-year rule sooner (she can file up to 90 days before reaching 5 years). Only if she got her green card after Apr 2018, would it be faster under the 3-year rule.

          Thank you very much newacct. Everything is good but I am u.s. citizen jan2020.(your line “you have been a US citizen for 3 years.”) so now is it she apply for N-400?

            I don't understand your question. She files N-400 to apply for herself to naturalize when she meets the conditions for naturalization. Like I said, she will not qualify for naturalization under the 3-year rule until Jan 2023, i.e. 3 years after you have become a US citizen.

                  newacct has been very clear in replies, but you do not seem to have grasped the point yet. Your wife needs to have been married to a US citizen for 3 yrs. in order to qualify for naturalization under the 3 yr. rule. If you become a citizen in 2020, she will qualify only in 2023, which is later than when she would qualify under the 5 yr. rule. So she would be better off waiting for the 5 yrs. and applying under that rule.
