  • Citizenship Issue

Hello Friends, I need some suggestions based on your experience.
I applied for my Citizenship, based on Marriage on 12/12/19.
On 1/13/20 , I completed the fingerprinting process.
On 1/20/20 my wife told me she wants a divorce. However, we have not filed any divorce papers yet. We are in the process of separating the assets. Once, the assets are separated we will file for divorce. We will filing the papers in about 3 months.
We had been going marriage counseling and the marriage was in good faith.
What should I do, if I get called in for an interview before we file the divorce papers?
My question is, has anyone been in a similar situation? If yes, what did they do during the interview with Immigration Officer and what was the result?

Hi, I am sorry to hear about your divorce but it happens.
    1. You didn't lie on your application because you were still legally married when you sent your application in.
    2. What state are you, because divorce is not usually a fast process.
    3. What's the processing time for citizenship in your state? Because if you interview comes up before you divorce you are also not lying because you would still be legally married.
    4. I suggest that you slow down the process of filing your divorce paper until your interview just be on the very safe side, but it's not likely that they will asked about your marriage if they believe it was good faith from the time you got your green card.
5.My situation was a little different, but my best friend was in a very similar situation to you. She was living in NY and divorce is not the fastest process here. She was able to stall submitting the divorce papers until after her interview. The entire citizenship process took 7mths.

    Good luck!

adisidd To add to Dababe05 Everything is based on case-by-case sceanrio. My question for you is

Are you applying for the Citizenship based on marriage within 3years ?

If it is then you have to be very careful and stall down the divorce process as Dababe05 said.

If it is not then you don't have worry about it.
