  • Many speeding tickets

    Hi there,

I am filing for N400. I have been an LPR for 17 years now; spent 14 years in MA and 3 in MN.

I racked up 8 speeding tickets and two miscellaneous violations in in the 14 years I was in MA, and got one expired tags and 1 speeding ticket in MN in the last couple of years.

In total, in the last five years (statute of limitations for “good moral character”) I have got 3 speeding tickets and one expired tags ticket.

All of my tickets were paid off. All of them were under $150 except for one which was $200 (way back in 2006).

I have never been arrested, have never been in trouble with the police or any other legal matter. I have led a clean life. I have a high paying job and pay taxes, on time, every time.

Anyway, I am thinking of applying for citizenship and my lawyer is getting worried that due to my speeding violation record I may be denied.

I understand that I shouldn’t have been speeding. However all is paid and things never got to the point of license suspension or anything like that.

My question to you folks here, and especially immigration lawyers, should I be concerned about my traffic record and is my lawyer correct that my speeding ticket record will lead to a denial of citizenship on good moral character grounds?

    Thanks

I'm not a lawyer, just a regular guy who follows this blog.

In my opinion, you don't have worry about the speeding tickets at all and no need to share that info with anyone.

I know there is nothing wrong in sharing with attorneys but some attorneys they don't the stuff but they will freak us out.

Unless you have DUI or any arrest or any court stuff then you need to worry about it but not for the speeding tickets where fine is less than $500.00 and even you don't have to disclose that information.

Hey thanks for the response! Very kind of you to say that. I was very worried that my lawyer was freaking out over speeding tickets.

i have never had my license suspended or my privilege to drive revoked. I have never had a situation where the ticket was over $200. I have never been arrested or have had a run in with the law. My career would be destroyed if any of that had happened.

in any case i will put YES on the citation and can reproduce my entire driving record but only if asked. I am not a fan of volunteering unnecessary information. Is this the right strategy? Has anyone had experience with so many speeding tickets? (Granted they are over nearly two decades)

It should not affect your naturalization, but you need to disclose it on the N-400 form, Part 12 #23, "Have you EVER been arrested, cited, or detained by any law enforcement officer (including any immigration official or any official of the U.S. armed forces) for any reason?"

This is my personal opinion and is not to be construed as legal advice.

Do I need to attach my entire speeding citation “rap sheet” with the N400? Or should I leave it at YES ?

If I were you, I wouldn't create any complications in my petition especially with the current administration.

You should list all the tickets, but per the N-400 instructions, you don't need to attach additional documentation about the ticket if there was no arrest or drugs or alcohol, and the fine was less than $500.

dont worry too much. Be truthful and keep all documentation ready. I had a DUI but was approved. All the best!

You are worried about nothing. Speeding tickets by themselves are not proof of bad moral character. Just make sure of two things: First, disclose the fact that ypu got them (even though they are under $509 Second, fire your attorney, who is trying to sell on fear.

If i was you . First thing i would do is filing my self alone with no lawyer . Traffic violations is not a concern unless accompanied with ARRREST , ALCOHOL , ACCIDENT LEAD TO INJURY , OR more than 500 $ a ticket .
Also its better for you to file online , diaclose each insidence by answering Yes to that question asking about citatios . and attach all these payments for the tickets .

Good luck and waiting to hear good news from you
