N400 Decision cannot be made

  • N400 Decision cannot be made

    So...i had my interview yesterday. My GC was obtained via marriage but i filed under the category of having been a PR for more than 5 years, since my spouse and I are now separated (separated after 5 years and 4 months of marriage. We are still legally married). I have tax liability because of all that, and currently in a payment plan with the IRS. The IO said they will send me a letter requesting more documentation that I have been making payments and at one time she said "and any other information we need". Passed the English and Civics test but hanging on "Decision cannot be made".
    Any words of wisdom/similar experiences?

    EDIT: i also signed 4 affidavits for name change that I requested and an online document that said I agree to the oath of allegiance if my case will be approved.

    Hello there,.....You're not alone! I'm in the same situation/****-tuation. I passed me ENGLISH & CIVICS test also & I got a DECISION CANNOT BE MADE. There's no time limit or time frame of when the will act on ur case again. It's sound sad but, it's truth. I did mine N-400 interview since JUNE 2019 & upon till now they can't/won't give me an OAT CEREMONY DATE????. I'll advise you to keep calling them ( USCIS ) to get updated on what's going on with ur case. Another thing..... my IO/interviewing officer said he will mail to me a request from of what he needs from me and I've still ain't received anything as yet!... They dragging their feet my dear.

      Please help.

      i attended to Citizenship interview and passed the exam. In N652, IO checked decision not made.
      I applied my N-400 application in August and changed my job in October. I mentioned this during my interview process.

      IO told me that she cannot make a decision now then I asked her if she was looking for any additional documentation and I have everything with me. She said no I don’t need anything right now I have everything to verify. You may see changes by end of the day today or tomorrow morning at the earliest. It’s been 4 days but no updates on my case.

      please anyone has similar experience and how long did it take to complete?
      I have to visit my parents in May.

          Your waiting time depend to your office traffic on N400, look here to find how is your office: https://egov.uscis.gov/processing-times/
          If you do not receive RFE letter in 2-3 weeks then use your online account message service and send inquiry about delay for RFE letter which was told you in interview, Please inform us when you get any new update.

              Did you bring your tax return transcripts to interview? I might have similar issue

                My online account shows RFE in Documents tab but when i click on it the page errors out. Depending on what the document/letter states, I might have to involve an attorney. I had my transcripts from the IRS' web site for the interview. Just recently filed my taxes for 2019 (after the interview) and hopefully based off the estimated Federal refund, I should be able to wipe off 2/3 rd of my outstanding IRS balance. I am so hoping that is all they want. But until i get the letter or the damn document is available in my online account - I am just hoping it is nothing severe for them to kick me outta this country :-(

                  If you could not see your RFE letter online, use your online message center and send inquiry about that, usually they respond in 1-2 days and hopefully you will find RFE in their reply.
                  I saw in news today that IRS give 3 month delay to pay tax cause of corona. Do not be so worry, you need be patient, we must wait longer time for finishing this process due to all close office cause of Corona.There is too many canceled interview and Oath ceremony as you can see in posts.

                        So the online case status page just updated with notice for second rfe. No idea any more whats going on.
                        When I login to my account, just see the Response Submitted for first RFE with a date of today.

                          Given that your Green Card was obtained through marriage but you filed under the category of having been a PR for more than 5 years, it's possible that the IO wants to verify the details of your case to ensure accuracy and eligibility. The fact that you and your spouse are separated might also be a factor they are looking into.
                          The IO requesting more documentation regarding your IRS payment plan is not unusual, as they want to ensure you are meeting your tax obligations. Be sure to provide all the requested documentation promptly and accurately​ pge outage map
