  • Applied Naturalization whilst conditional residency conditions are removed

    Hey,

Thank you in advance for anyone reading this and for any info/ advice.

I moved out to California with my US wife back in 2016 after arriving on a fiance visa. We married within the 3 months and applied for conditional residency. I've held that for 3 years in September 2020 as there was a long delay in sending my temp green card due to a missing medical vaccination . I just applied for naturalization a few days ago.( 3 months early as permitted ). I was wondering how it works as I still have not had my conditions removed yet. I received the letter extending my conditions etc so I am here legally and I am still married to my wife etc. I've read that you have your conditions removed on the same day of your interview..not sure if that is correct?

I'm just hoping to get the process completed asap to allow more career opportunities. I was and still am a police officer in London, England after i took a 5 year career break so I'm hoping to obtain citizenship before I have to resign in July 2021. Citizenship will allow me to apply for law enforcement careers out here in the US.

Oh and any advice on the test questions? I'm not going to lie, my knowledge of US history is not that great so I've started reading up on it.

    Thanks again

    Barney

    - You must file for I-751 first. It does not have to be approved, but you must file for it & obtain the USCIS receipt of filing.
    - Then, you can file for Naturalization if you meet the 3 yr criteria (if married to a US citizen)
    - N400 will not be approved until I-751 is approved / adjudicated. This means, if you are called for an N400 interview, the officer may
    1. Only conduct the N400 interview (if they do not have your I-751 file), and if you pass, keep your N400 application in continuance" till your I-751 is approved. Then you will receive the approval & oath letter
    2. The officer may conduct the N400 & I751 (combo interview) at the same time. In such cases, they will approve both applications if you meet all criteria.
Opinion only. Cannot be construed as legal advice.

Hi, must it only be after you have held your permanent residence status for 3 years that you can start the process of applying for N400?
