  • Failed Citizenship interview twice

    My 65 year old mother failed her 2nd attempt in understanding English yesterday. She passed the other portions the first time.
    I made a mistake of not hiring a lawyer for the second time to go in with her. They interviewed her for 40 min and apparently she did well because they put an iPad in front of her to sign her form.(usually last step) She couldn’t figure out how or where to sign. Not tech savvy at all.
    she panicked because she couldn’t understand the instructions( didn’t know what scroll down means )
    anyways has anyone ever tried to appeal this kind of denials?
    we are not even sure how soon we can re-apply since her denial letter doesn’t mention it and I couldn’t find anything in USCIS website.
    Please get a lawyer to go in for your elderly parents if their English knowledge might be limited and if they need an advocate as when I talked to one after the fact I was told that lawyers have stepped in at the end so the applicant can find the place to sign.
    it’s heartbreaking and unfair.

    It's very sad. I am sorry to hear that. I hope you can apply for her soon. Sorry I don't have any advice, but the best bet is to contact a lawyer now at least (there are some who provide low-cost services especially to elderly people). Perhaps there is a way to appeal the decision.

      Thank you. It’s sad. I have contacted an attorney but it appears it’s hard to overturn the decision in these cases and it might be faster if we re-apply since the cost is the same.

          Yes but if we appeal there is no guarantee and still costs $700 just the application fee.

            Some community colleges or other organizations offer free English as second language classes (or very low cost). That may be a good option too. Good luck.

                Yes and we were using it until covid hit and those places got closed.
                she did well for the entire exam, just panicked at the end when she was supposed to sign the ipad which is basically the last step. She couldn’t figure it out and Now I know that’s a step that has caused confusion for elderly based on my conversations with couple of lawyers . They could have scrolled down for her to sign.
                just very unfair after questioning all of N400 questions for 40 minutes.
