I have lived in the USA as a legal permanent resident for more than 3+ years, my husband just became a USA CITIZEN last week. Can I now submit my application to become a US citizen, since my husband is NOW a US Citizen. The N-400 application states if married to a US Citizen for 3 years you could then apply. Or do I still need to wait the full 5 years since I initially came into the US married to a permanent resident and he just became a US Citizen?

So your spouse doesn't need to have been a citizen when you became a permanent resident for you to qualify under the 3-year rule, but, effectively, his naturalization would only help you naturalize faster if it took place in the first two years of your permanent residency.Last edited by newacct; 09-09-2020, 03:46 PM.
