    I have lived in the USA as a legal permanent resident for more than 3+ years, my husband just became a USA CITIZEN last week. Can I now submit my application to become a US citizen, since my husband is NOW a US Citizen. The N-400 application states if married to a US Citizen for 3 years you could then apply. Or do I still need to wait the full 5 years since I initially came into the US married to a permanent resident and he just became a US Citizen?

    Yes you can, you need to prove bona fide marriage, Joint Tax returns, joint bank statements, joint lease or mortgage, joint bills, pictures, IDs with same address, naturalization document from spouse.

      To qualify for naturalization under the 3-year rule, you need to have been a permanent resident for 3 years (can file 90 days before that), you must have been married for 3 years, and your spouse must have been a US citizen for 3 years. Since your spouse just became a US citizen last week, you would only qualify for naturalization under the 3-year rule 3 years from last week. You would qualify for naturalization under the 5-year rule faster.

      So your spouse doesn't need to have been a citizen when you became a permanent resident for you to qualify under the 3-year rule, but, effectively, his naturalization would only help you naturalize faster if it took place in the first two years of your permanent residency.

        if only depending yousele, only need 1 more yr.
