I will try to be brief.
Came to USA May 8th 2008 from England.
Got married
Had child 03/03/09
Four years later, broke up with wife.
Filed for divorce 2015
Moved house
Now 2020 I want to apply for citizenship
My greencard expires July 2021
Here's my problem,.
Since 2015 we read the divorce papers and there was a stamped note that said "divorced as of x/x/2015"
We thought we were divorced.
So I filed my taxes as Single, Head of household since that date.
But my friend (ex lawyer) checked in court house and we did not receive the final decree of divorce. So we have been married this whole time
If I apply for citizenship, I should put married on the forms. But they will see I have been filing single on my taxes.
Do i write a letter to explain the situation>?
We are filling the final papers to try to get a backdated divorce asap.
ALso, I am not sure if i changed address with the immigration authorities. Will that be held againt me in a big way?
If I apply, my income seems low. (10k consistently each year).
But I live in a place where I exchange hard work for rent.
I pay my heating bill with firewood I cut myself.
We live in a tiny town in the woods.
I found a way to survive, and it is not working for a big company in town. Just to drive to town costs 500 in gas a month.
I have two chidren, one is not my biological, he is my son, though. Since his first birthday,.
Since we broke up, i have taken care of them 50% of the time consistently. Me and ex wife are on good terms and I am just as much in my childrens lives as she is. I do my part and take care of them.
The thought of not being allowed to stay here in this life I have created is already killing me. I will not make it if I have to go back to England and start again. This is my life here. I cut and sell firewood. We had a head on crash me and kids at 50mph and walked away. I am selling the parts from the old truck I tore down bolt by bolt.
Do I write a letter explaining my situation with my citizenship application? Or will it be ignored anyway?
Any help would be so greatly appreciated. Time is running out for me to apply. As far as I know, there's a 6 month window before my greencard runs out. I hope I am correct with that statement!!
