In 2012 I got a DUI in San Jose CA, I am not sure how to correctly answer the questions regarding this.
I was picked up at around 1:00am and released 9:00am
I had to attend a 3 month "Driving Under the Influence Program" (1 night, and Saturday) DUIP and I had to perform 5 days (40 hours) with Sentencing Alternatives Program
I want to make sure I answer the questions properly, so would the following be correct:
Have you EVER committed, assisted in committing, or attempted to commit, a crime or offense for which you were NOT arrested? NO
Have you EVER been arrested, cited, or detained by any law enforcement officer (including any immigration official or any official of the U.S. armed forces) for any reason? YES
Have you EVER been charged with committing, attempting to commit, or assisting in committing a crime or offense? YES
Have you EVER been convicted of a crime or offense? YES
Have you EVER been placed in an alternative sentencing or a rehabilitative program (for example, diversion, deferred prosecution, withheld adjudication, deferred adjudication)? YES
Have you EVER received a suspended sentence, been placed on probation, or been paroled? NO
Have you EVER been in jail or prison? YES (I was picked up around 1:00am and released 9:00am)
How long were you in jail or prison? 1 day (overnight - is this correct answer ??)
