  • N-400 While I-751 Outstanding

    Hello Everyone,

I just joined this forum and had a few questions; was wondering if you all could help based on your experiences.

My wife and I are getting ready to file for her N-400 application as she is within 3 months of the 3 year timeframe required to file for her naturalization. Could you folks please answer the following questions:
    1. We'll be applying for the N-400 in the next few days, however, we currently live in NYC and our lease expires at the end of November, and we're not planning on renewing the lease; is it okay for us to, later on in December, change our address to a Virginia address which is my parents' address as we might be staying there during that time? Will it affect the processing times? We will change it back to an NYC address once we sign a new lease early next year.
    2. We can apply for the N-400 even if don’t have the physical green card, correct? We can just send in a copy of the I-751 extension letter that we received?
    3. My wife can apply for the name change on N-400, correct? Does that delay the processing?
    4. How long is it taking biometrics to come through?
    5. Does anyone have a list of evidence they sent in with their application? Is it basically the same list that you send in with your I-751 or is it less extensive?
I-751 - Petition to Remove Conditions on GC
    1. Is there always an interview for the green card if it says “Case is ready to be scheduled for an interview?” It was transferred to the National Benefits Center and this status was updated in late June.
    2. Are they interviewing most applicants since the new guidance in December, 2018?
    3. Can you go to a local USCIS office to get an extension for I-751 after getting an appointment?
    4. If the GC and Naturalization wait times are very long, do you have to keep extending it?

Appreciate any and all the help.

    Thank you.

        1. it's better not to change the address to different jurisdiction if you don't have to, this will cause your case to be shipped around and causes delays
      2. We can apply for the N-400 even if don’t have the physical green card, correct? We can just send in a copy of the I-751 extension letter that we received?
        1. yes, you can apply as soon as you are eligible
      3. My wife can apply for the name change on N-400, correct? Does that delay the processing?
        1. yes, but not all offices do that, it does not affect the processing, depends on location, if requires a court ceremony might delay to find an available schedule
      4. How long is it taking biometrics to come through?
      5. Does anyone have a list of evidence they sent in with their application? Is it basically the same list that you send in with your I-751 or is it less extensive?

      2. Are they interviewing most applicants since the new guidance in December, 2018?
        1. not sure, I think they interview when they abs have to
      3. Can you go to a local USCIS office to get an extension for I-751 after getting an appointment?
        1. yes, if passed the date
      4. If the GC and Naturalization wait times are very long, do you have to keep extending it?
        1. yes, if you need prove, otherwise you are legal

As evidence to support the N-400 I added the tax filings for the last 3 years- jointly, the car that is on both names, a gas bill and some pictures together.
