  • Naturalization Questions

    Hi,

Me and my family members received our Green Card/Permanent Residency in November 2015. Little over 5 years now.
During these 5 years, we (all family members) traveled outside of the US for few months. 2 months in 2016 and 1 month in 2019. Also, I alone traveled outside of the US in August 2020 for one month.

Do these periods of absence during the last 5 years be a problem or disqualify me from filing the N-400? Do I need to wait for 4 more months to file?

Per the below conditions stated on the USCIS's site do my family and me qualify to file N-400 immediately now?

    ttps://www.uscis.gov/citizenship/learn-about-citizenship/citizenship-and-naturalization/i-am-a-lawful-permanent-resident-of-5-years
    • Demonstrate continuous residence in the United States for at least five years immediately before the date you file Form N-400.
    • Show that you have been physically present in the United States for at least 30 months out of the five years immediately before the date you file Form N-400.
    • Show that you have lived for at least three months in the state or USCIS district where you apply. Students may apply for naturalization either where they go to school or where their family lives (if they are still financially dependent on their parents).
    Please help.

    - M

You are fine. You did not interrupt continuous residence because you did not have absences of more than 6 months. (Plus, if you did interrupt continuous residence, you would have to start over; it is not a matter of waiting a few more months.) You have way more than 2.5 years of physical presence so no problem there.

This is my personal opinion and is not to be construed as legal advice.

Thank you so much newacct for your quick response.
      .
After I file my N-400, while my application is being processed can I travel outside of the US and can I renew my Indian passport while the application is being processed.

Yes. Just make sure not to interrupt your continuous residence by staying out more than 6 months.

Thanks again newacct for your response. So, while the application is being processed it is fine if I travel for few weeks but should not be more than 6 months? Please confirm.

          Thanks
