  • Dual citizen wife applying for natutralization

    Hello community!

I am an Italian citizen and my wife is from an Asian country (let's call the country AAA). We came to the US independently 12 and 11 years ago, got married in 2012 and obtained our green card (employee-based) in 2015. My wife obtained her Italian citizenship about two years ago while living in the USA, so she is now citizen of both AAA and Italy. She has the two passports. We got the Italian citizenship because her AAA passport required always a visa for entering Italy.

When filling the N400 for naturalization in part 2 there are two questions: "10. Country of birth" and "11. Country of Citizenship or Nationality". The instructions for line 11 are actually clear and say that
If you are a citizen or national of more than one country, type or print the name of the foreign country that issued your last passport.
so she should indicate she is Italian as that is her latest passport. My concern is that her previous immigration steps (various visas and green card) have obviously been done using her AAA passport and she has never really used her Italian passport so far. For example she has never been admitted to the USA showing the Italian passport and the Green card, as she used the AAA passport and the green card.

Should we go by the letter and indicate she is Italian?
    thanks a lot

Putting Italian is fine. The US doesn't care about changes in (or gain or loss of) nationality of a permanent resident.

This is my personal opinion and is not to be construed as legal advice.
