  • Is visa required for child of US citizen

I am a US citizen through naturalization. My husband is Bangladeshi. Our 6 month old baby was born in the UK. We applied for his CRBA but it got denied because I couldn’t prove 5 years of physical presence in the US. My baby can have a Bangladeshi passport through his father.

I have to go to the US for a temporary visit however my child is fully dependent on me and so I am curious to know if he will need a visa to travel with me if I can prove our relationship with his birth certificate.

I do intend to apply for his immigration visa (i-130) in the future but I want to know about temporary travel visits since I have to visit US soon. If I do need to apply for a temporary visa for my baby, considering that I will be applying for his immigration visa in the future, do I apply for a K-4 visa or just a normal tourist visa?

    TIA

Yes, your son needs a US visa. A B2 visa would be the appropriate visa for him to visit as a nonimmigrant. There is a chance he may be denied a visa and/or denied entry due to immigrant intent.

This is my personal opinion and is not to be construed as legal advice.
